Welcome to Kesari. These Terms of Service govern your use of kesarishop.in and any purchase made through it. By accessing this website or placing an order, you agree to be bound by these terms.
This website is operated by Kesari The Ethnic Store, having its registered office at 22, Harekrishna Market, 10 No. Market, Bhopal, Madhya Pradesh — 462016, India. References to "we", "us", "our" and "Kesari" refer to Kesari The Ethnic Store.
1. Eligibility
You must be at least 18 years of age, or accessing the site under the supervision of a parent or legal guardian, to place an order. By placing an order you confirm that the information you provide is accurate and complete.
2. Products and handcrafted variation
Our garments are made using traditional hand block printing, Ajrak, Dabu and natural dyeing techniques. Slight irregularities in print, colour, weave and finish are inherent to handcrafted textiles and are not defects. These variations are the signature of handmade work.
Product photographs are shot as accurately as possible, but colour may appear differently across screens and devices. Minor colour variation between the image and the delivered garment is not grounds for a defect claim.
Fabric care instructions are provided with each garment. Damage caused by incorrect washing, drying, ironing or dry cleaning is not covered.
3. Pricing and payment
All prices are listed in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise. We reserve the right to change prices, withdraw products, or correct pricing errors at any time without prior notice.
If a product is listed at an incorrect price due to a technical or typographical error, we reserve the right to cancel the order and refund any amount paid.
Payments are processed through third-party payment gateways. We do not store your card, UPI or netbanking credentials.
4. Order acceptance
Your order is an offer to purchase. We reserve the right to accept or decline any order, in full or in part, including where:
- The product is out of stock
- There is an error in pricing or product description
- We are unable to verify the delivery address or contact details
- We suspect fraudulent, abusive or bulk-resale activity
Where an order is cancelled by us, any amount paid will be refunded in full.
5. Returns, exchanges and shipping
Purchases are governed by our Returns & Exchanges Policy and Shipping Policy, both of which form part of these Terms.
6. Intellectual property
All content on this website — including photographs, illustrations, product designs, text, prints, motifs, the Kesari name and logo — is the property of Kesari The Ethnic Store and is protected under applicable Indian law. You may not reproduce, distribute, republish or use any of it commercially without our written permission.
7. Acceptable use
You agree not to use this website for any unlawful purpose, to attempt unauthorised access to our systems, to interfere with its functioning, or to scrape, copy or harvest content or customer data.
8. User content
If you submit reviews, photographs, comments or other content to us or to our social channels, you grant Kesari a non-exclusive, royalty-free right to use, reproduce and display that content for marketing purposes, with credit where practical. You confirm you own the rights to any content you submit.
9. Limitation of liability
To the maximum extent permitted by law, Kesari's total liability in relation to any order is limited to the value of that order. We are not liable for indirect, incidental or consequential losses, including loss of profit or opportunity.
Nothing in these Terms limits your rights under the Consumer Protection Act, 2019.
10. Force majeure
We are not liable for delay or failure in performance caused by events beyond our reasonable control, including natural disasters, epidemics, strikes, transport disruption, regulatory action or courier failure.
11. Third-party links
Our website may contain links to third-party sites. We are not responsible for their content, policies or practices.
12. Changes to these terms
We may update these Terms at any time. The version published on this page at the time of your order applies to that order.
13. Governing law and jurisdiction
These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts at Bhopal, Madhya Pradesh.
